Firm Wins Quiet Title Lawsuit
September 06, 2010

The Firm was successful in clearing title for nearly two acres adjacent to Auburn University. The August 11, 2010 decision by Circuit Judge Jacob Walker awarded sole possession to the Firm client for the disputed tract which was the subject of the multi-million dollar "Copper Hills Condominiums" development, within walking distance of Jordan Hare Stadium.

After site preparation, further work on the condominium development was halted on filing of the suit in 2007. The ruling followed week long trial involving evidence of adverse possession from 1938, and extensive title research for the client dating from the original patent signed by President Martin Van Buren, and assessment records from the 1960's. The property had been the site for the first black schoolhouse in Lee County.

The trial decision overruled an adverse finding by the Lee County Map Room and Appraisal division, who had attributed ownership to an adverse party. Firm partner Greg Buffalow was lead counsel in the litigation.
